Text Message Campaign Terms and Conditions

These Text Message Campaign Terms and Conditions (“SMS Terms”) govern your participation in the Crosslink Network Operations text-messaging program operated by Crosslink Networks (“Company” ).
1. Program Description
When you enroll, you authorize us to send [marketing, promotional, informational, customer-service, appointment, billing, and/or account-related] text messages to the mobile telephone number you provide. Messages may include customer specific billing information, or network outage information.
Messages may be sent using an automatic telephone dialing system or other automated technology.
2. Consent to Receive Messages
By providing your mobile number and affirmatively opting in, you expressly consent to receive recurring text messages from or on behalf of Crosslink Network at that number.
Your consent applies only to messages from Crosslink Networks. Consent to receive marketing text messages is not a condition of purchasing any property, goods, or services.
You represent that:
- You are at least 18 years old or have the permission of a parent or legal guardian;
- You are the subscriber or customary user of the mobile number provided; and
- You are authorized to consent to receive messages at that number.
3. Message Frequency
Message frequency will vary but may not exceed approximately 5 messages per week, except when additional messages are necessary to respond to your requests or address account or service matters.
4. Message and Data Rates
Message and data rates may apply according to your wireless service plan. You are responsible for all charges imposed by your wireless carrier. Contact your carrier for information about your text-messaging and data plan.
5. Opting Out
You may opt out at any time by replying STOP to any message. You may also use another reasonable method that clearly communicates your request, such as contacting us at billing@crosslinknetworks.com or (510)663-5686.
After an opt-out request, we may send one non-promotional text confirming that your request was received. We will process valid opt-out requests within the period required by applicable law.
Other recognized opt-out words may include QUIT, END, REVOKE, OPT OUT, CANCEL, and UNSUBSCRIBE. The FCC’s current rules allow consumers to revoke consent through any reasonable means and prohibit a sender from requiring one exclusive opt-out method. 47 C.F.R. § 64.1200.
If you participate in more than one Company messaging program, please identify the program or category of messages you want stopped. Where applicable law requires a broader opt-out, we will apply your request accordingly.

7. Privacy
We collect and use information associated with the messaging program as described in our Privacy Policy, available at https://www.crosslinknetworks.com/smsprivacy.
We do not sell, rent, or share mobile telephone numbers, SMS consent records, or opt-in information with third parties or affiliates for their own marketing or promotional purposes. We may provide this information to vendors that assist us in operating the messaging program, subject to appropriate use restrictions.
8. Supported Carriers and Delivery
The program may not be available through every wireless carrier or on every device. Wireless carriers are not responsible for delayed or undelivered messages.
Message delivery depends on your carrier’s network, your device, and other factors outside our control. We do not guarantee that every message will be received.
9. Changing or Reassigned Numbers
You agree to notify us promptly if you stop using or no longer control the mobile number enrolled in the program. You may provide notice by contacting support@crosslinknetworks.com or (510)663-5686.
If your number changes or is reassigned, you agree to opt out before discontinuing its use. You are responsible for keeping your contact information accurate.
10. Prohibited Conduct
You may not use the messaging program to:
- Send unlawful, abusive, threatening, fraudulent, or harmful content;
- Interfere with the program’s operation;
- Impersonate another person;
- Introduce malicious software or code; or
- Violate another person’s rights or applicable law.
11. Program Changes and Termination
We may suspend, modify, or discontinue the messaging program at any time. We may also suspend or terminate your participation if we reasonably believe you have violated these SMS Terms.
Termination of the program does not eliminate rights or obligations that arose before termination.
12. Changes to These Terms
We may update these SMS Terms periodically. Updated terms will be posted at [direct SMS-terms URL] with a revised effective date. When required by law, we will provide notice or obtain additional consent before materially changing the program.
13. Governing Terms
These SMS Terms supplement our general SMS Terms of use, available at https://www.crosslinknetworks.com/smstermsandconditions. If there is a conflict concerning the text-messaging program, these SMS Terms control.
These terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute provision, arbitration clause, class-action waiver, or venue clause should be inserted only after review by qualified counsel.
